Five for 5 Official Contest Rules & Regulations

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

1. CONTEST PERIOD:  The Hawaii Community Federal Credit Union (HCFCU) Five for 5 Contest (“Contest”) begins on August 2, 2024 and ends on December 31, 2024 (“Contest Period”).
2. ELIGIBILITY:  The Contest is open to residents of the County of Hawaii, 18 years or older as of the date of their entry.  Must be a member in good standing to enter. The Contest is not open to employees and representatives of the Contest Sponsor, including its sponsors, advertising and promotional agencies and members of the immediate families of such employees or representatives and persons with whom such employees and representatives are domiciled. For the purpose of this Contest, "immediate family" is defined as parent, sibling, child or any person residing in the same household as, or domiciled with, any such employees or representatives.  The Contest is void where prohibited or restricted by law.
3. HOW TO ENTER:  No purchase or transaction is necessary to enter or win.  There are three (3) ways to enter the contest during the Contest Period:
   1. Entry Method 1:  You earn one (1) entry into the contest when you establish membership with HCFCU.  Membership is a regular share account with a minimum balance of $50.00. When you establish membership, we will ask for your name, physical address, date of birth, taxpayer identification number, and other information that will allow us to identify you. There is a limit of one (1) entry per member throughout the Contest Period.
   2. Entry Method 2: You earn one (1) entry into the contest when you refer a new member. To qualify for the promotion, referred member must establish membership by end of promotional period and not have had a membership account or loan with HCFCU during the preceding six months. Promotion does not apply to new members being added to an existing HCFCU account.
   3. Entry Method 3:  You earn one (1) entry into the contest when you complete an entry at the Hilo Branch of HCFCU located at 111 Aupuni St., Hilo, HI 96720. One entry, per person, per visit each month during the Contest Period.
4. WINNER SELECTION/NOTIFICATION/AFFIDAVITS:  One (1) winner will be selected by a random drawing no later than the end of the first week of the following month for each of the five months in the Contest Period by the Contest Sponsor from entries received during the Contest Period. 
   1. Potential winners will be notified in-person, or by telephone, U.S. mail, or email. All potential winners must comply with all terms and conditions of these Official Rules, and being declared an official winner is contingent upon fulfilling all requirements set forth herein. Potential winners may be required to sign and return an affidavit of eligibility/compliance (including providing his/her Social Security Number for tax purposes) and a publicity/liability release ("Release"), as allowed by law, within five (5) calendar days of notification attempt or he/she will forfeit the prize. In the event of prize forfeiture, a potential winner is unreachable, the prize notification is undeliverable, or if a potential winner declines acceptance of the prize, Sponsor may award the prize to a randomly selected alternate potential winner. All potential winners of the Contest are subject to verification by Sponsor, whose decisions as to the administration and operation of the Contest and the selection and verification of potential winners are final and binding in all matters related to the Contest. All materials submitted become the sole property of Sponsor and will not be returned.
   2. The winner may be announced on www.hicommfcu.com and will be contacted personally by the Contest Sponsor via phone and/or email. The winner may also be announced in newsletter and press release formats. Before being declared a winner, the selected entrant may be required to show proper photo identification. Any selected entrant who cannot be contacted (or who fails to respond to any telephone message or email left for such selected entrant), or who refuses to sign a declaration and release form within 5 business days of the Contest Sponsor's first attempt to contact such selected entrant may, at the sole discretion of the Contest Sponsor, be declared ineligible and the Contest Sponsor reserves the right, in such event, in its sole discretion, to determine one or more additional entrants whom they shall attempt to contact, and who shall be subject to disqualification, in the same manner.
5. ODDS OF WINNING:  The odds of winning a prize depends on the number of eligible entries received.  For example, if 1,000 entries are received, the odds of winning a prize are 1/1,000. 
6. PRIZES:  Five (5) $500 cash prizes in the form of an account credit or check, as described below.  A Member can opt to accept the prize via deposit directly into his/her Hawaii Community Federal Credit Union account or as a check. Any person who wins prizes through the Prize Drawing Sponsor’s promotions with cumulative value equal to or greater than $600 in a calendar year will receive an IRS 1099 MISC Tax Form in the mail for the value of the prize, to be processed in the year in which he/she receives the prize. The winner will be solely responsible for all applicable federal, state and/or local taxes, and for any other fees or costs associated with the prize awarded.  Consult your tax advisor and/or financial advisor regarding the tax implications.  No prize substitutions or transfer of prizes permitted except at sole discretion of the Sponsor.
7. GENERAL CONDITIONS:  By entering this Contest and/or accepting a prize as a selected winner, each entrant/winner agrees that he/she has read these Official Contest Rules and that he/she will be strictly bound by them. The Contest Sponsor reserves the right to modify the Contest Rules without materially affecting the terms and conditions of the Contest.  Subject to all applicable federal, state and municipal laws and regulations, these Contest Rules govern all aspects of the Contest and are binding on all participants.
8. GENERAL RELEASE:  The Contest Sponsor extends absolutely no representations or warranties in respect of any prizes and accepts no liability arising in respect of such prize. Each entrant herby agrees to release, indemnify, and hold harmless Sponsor & Others, from any claims, actions, damages, losses or injury of any kind including but not limited to personal injury or death, resulting from participating in the Contest or form acceptance, use or misuse of a prize awarded or participation in any prize-related activity.
9. LIMITATION OF LIABILITY: Sponsor is not responsible for lost, late, mutilated, delayed, inaccurate, incomplete, postage due or misdirected Entries, processing Entries, internet access or other connections, miscommunications, failed telephone or computer transmissions/failures of any kind or jumbled, scrambled or misdirected Entries, or for phone, electrical, network, computer hardware or software or program malfunctions, inability to upload or download any information in connection with participating in the Contest, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person or person’s computer or property related to participating in the Contest. Persons found tampering with, abusing any aspect of this Contest, or violating these Official Rules, will be disqualified and may be subject to prosecution. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner or Entry based on an automatic Entry, the winning Entry will be declared made by the Member who is the primary Account Holder, as determined solely by Sponsor’s records. IN NO EVENT WILL SPONSOR AND ITS AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPATION IN THIS CONTEST OR ACCEPTANCE OR USE/MISUSE OF ANY PRIZE
10. DISPUTES: ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY THROUGH BINDING ARBITRATION BEFORE A SINGLE, MUTUALLY AGREEABLE ARBITRATOR AND CONDUCTED IN KAILUA-KONA, HAWAII THROUGH DISPUTE PREVENTION & RESOLUTION, INC.; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST BUT IN NO EVENT ATTORNEYS’ FEES OR COSTS; AND (3) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ENTRANT FURTHER WAIVES ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Hawaii  without giving effect to any choice of law or conflict of law rules (whether of the State of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Hawaii.
11. WINNERS LIST: For a Winners List send a stamped, self-addressed envelope, postmarked no later than January 10, 2025 to Hawaii Community Federal Credit Union, Attn: Marketing/Five for 5, 73-5611 Olowalu St., Kailua-Kona, HI 96740. Requests must be received no later than January 3, 2025.
